CONTRIBUTIONS TERMS AND CONDITIONS
1 – Definitions
Contribution : any donation, bequest, voluntary disboursement, gift, bestowed in money, good, real estate to the Hydrosphere Association from Contributor, from whatever country she/he comes from, by means of electronic authorisation through the website(s) of the Hydrosphere Association, by notary deed, by bank transfer, by goods delivery by curier or otherwise, (cash excluded).
Contributor : any adult person, any legal entity that bestows, has bestowed or will bestow a contribution to the Hydrosphere Association.
Hydrosphere Association: Association „Hydrosphere Association“, a swiss indipendent, apolitical, non denominational and non-profit public utility association established under the swiss laws with his registered office in 6815 Melide, via al Doyro 6, Switzerland.
2 – Applicability
A) These Terms and Conditions apply separately to each single contribution, and they do not form a contract allowing for future or successive transactions to be set up.
B) By confirming on the website(s) of Hydrosphere Association that Contributor wish to make a contribution, the Contributor agrees to be bound by these Terms and Conditions for that contribution.
3 – The Contribution Service
A) Hydrosphere Association will use the contribution at own discretion but within the stated association’s purposes.
B) All payments through the Website are to be made by payment card or by bank transfer to our account.
C) Unauthorised card use : if Contributor become aware of fraudulent use of her/hjs card, or if it is lost or stolen, the Contributor must notify the card provider.
D) Before Hydrosphere Association can process a donation the contributor must provide
Hydrosphere Association with:
- the name and email address; and
- details of the credit or debit card that Contributor wishes to use to fund the donation.
E) Hydrosphere Association will use these informations to process Contributor donation.
F) It is Contributor responsibility to ensure she/he has provided Hydrosphere Association with the correct informations.
G) When Contributor submits her/his payment details, these details will be transferred to Hydrosphere Association’s payment provider, and Contributor’s payment data will be collected and processed securely by them.
H) Contributor should make sure that she/he is aware of payment provider’s terms and conditions, which are different from that of Hydrosphere Association, to ensure that Contributor is comfortable with how they will process Contributor’s personal data before to make a contribution.
I) Hydrosphere Association won’t share Contributor’s personal details with any other third party other than is set out in Hydrosphere Association’s Privacy Policy.
L) The Privacy Policy forms part of these Contributions Terms and Conditions and by agreeing to these Terms and Conditions Contributor is also agreeing to the way Hydrosphere Association uses and protects Contributor’s personal information in line with Hydrosphere Association’s Privacy Policy.
4 – Refund
A Contribution is irrevocable.
5 – General
A) – We reserve the right to amend these Donation Payment Terms and Conditions at any time.
B) The court of Lugano has exclusive jurisdiction to judge all disputes which arise between Hydrosphere Association and a Contributor concerning the contribution.
C) Swiss law applies to a Contribution and these Contributions Terms and Conditions.
